Terms of Service

These Terms of Service ("Terms") govern your use of Smashr, including our website and mobile apps (the "Service").

By using the Service, you agree to these Terms and our rules. The Privacy Policy and Cookie Policy explain how we handle data and cookies. If you do not agree, do not use the Service.

1. Who we are

Smashr is the operator of the Service. "We", "us", and "our" mean Smashr. "You" means you as a visitor or account holder.

2. Eligibility

You must be at least 13 years old to use the Service. If the law where you live requires you to be older, you must meet that older age.

You may not use the Service if we have banned you.

3. Accounts

Some features require an account. You are responsible for your account and for keeping your password to yourself. Tell us if you think someone else is using it.

Keep your account information up to date so we can reach you.

You can delete your account. We may keep limited records after deletion where we need them for security, abuse handling, backups, or the law. See the Privacy Policy.

We may suspend or close your account, or restrict access, if you break these Terms or the rules, if the law requires it, or if we need to protect the Service or other people. You can contact us if you think we got it wrong.

4. Your content

Your content is anything you submit to the Service.

You keep ownership of it. You are responsible for it. You confirm that you have the rights to post it and that it does not break these Terms, the rules, or the law.

You give us permission to host, store, and display your content as needed to run the Service. That permission ends when the content is deleted, except for copies we still need for backups, security, or the law.

We do not claim ownership of your content, and we do not endorse it.

5. Our content

The Service, including the Smashr name and logos, belongs to us. You may not copy or scrape the Service or other people's content except through the features we provide, or as the law allows.

6. Acceptable use

Use the Service in line with the law, these Terms, and our rules.

You must not:

  • Post anything illegal, or that you do not have the right to post
  • Harass, threaten, or incite harm against other people
  • Post spam, scams, or other deceptive activity
  • Impersonate another person
  • Try to break, overload, or bypass the security of the Service
  • Collect other users' information or send unsolicited messages
  • Use automated means to access the Service except ordinary search-engine indexing of public pages
  • Interfere with reports or moderation

This includes any content or activity related to child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM). See the next section.

7. Child safety

Smashr prohibits child sexual abuse and exploitation (CSAE). You will not post, share, solicit, or otherwise make available child sexual abuse material (CSAM), or engage in grooming, sexualisation, or any other exploitation or endangerment of minors. That includes images, video, text, and links.

Report CSAE or CSAM using the report tools on the Service, or contact us. We will remove that content, ban the accounts involved, and report it to the relevant authorities where the law requires it.

8. Moderation and reports

We host content that other people publish. We do not generally review it before it appears. We may review content when it is reported, when we become aware of a problem, or when we choose to.

You can report content that you believe breaks these Terms or the rules. We may remove or restrict content, or restrict access, because of a report, a legal request, a security issue, or a breach of these Terms or the rules.

If you disagree with a decision that affects you, contact us. We will look at it. We do not promise to reverse a decision.

If you believe content on the Service infringes your rights, contact us with enough detail to identify the content and your claim.

9. Third parties

The Service may include links or other material from third parties. We are not responsible for those third parties.

10. Privacy

How we collect and use personal data is described in the Privacy Policy.

11. Availability and liability

The Service includes content written by other people. That content is theirs, not ours.

We may change, limit, or stop offering the Service. We do not promise that it will always work, or that content you post will always remain available.

Nothing in these Terms takes away rights that the law does not allow us to take away.

We are not liable for other people's content or conduct, for third-party sites or services, or for loss that was not reasonably foreseeable.

12. Changes to these Terms

We may update these Terms. The date at the top will change when we do.

If a change is material, we will try to give notice on the Service. If you continue to use the Service after the update, you accept the new Terms. If you do not agree, stop using the Service and delete your account.

13. Governing law

These Terms are governed by Belgian law.

If you are a consumer in the EU, you may also bring a claim in the courts of the country where you live.

14. General

If a part of these Terms cannot be enforced, the rest still applies.

These Terms, together with our rules, are the agreement between you and us about the Service.
